1. Agreement to Terms

By accessing and using the WeSaidso mobile application ("App", "Service", "WeSaidso"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and WeSaidso ("we", "us", "our").

2. Eligibility

You must be at least 13 years old to use WeSaidso. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and current

3. Description of Service

3.1 Core Features

WeSaidso provides audio recording and AI-powered transcription services, including:

Simple Recording Mode:

  • Record audio conversations and meetings
  • Real-time transcription using Google Gemini AI
  • Multi-device recording coordination
  • Text transcript sharing via email/WhatsApp

VoiceVault Mode (Business Tier Only):

  • Multi-participant voice enrollment
  • Real-time speaker verification during recording
  • Immutable vault storage with SHA-256 hashing
  • Enhanced verification for sensitive conversations

3.2 Service Limitations

  • Transcription accuracy depends on audio quality, accents, and background noise
  • VoiceVault MVP uses basic voice fingerprinting (70-95% accuracy)
  • VoiceVault is NOT suitable for legal verification or authentication purposes
  • Real-time features require active internet connection

4. Plans and Pricing

💡 Key Point: VoiceVault is included in ALL tiers and uses the same minute balance as regular transcription. Your minutes are shared between transcription and VoiceVault recording.

4.1 Free Tier

Cost: $0 / R0 (Free)

Allowance: 40 minutes per month

Features:

  • 40 minutes of recording time per month
  • VoiceVault included (uses same 40 minutes)
  • Real-time transcription
  • Multi-device recording
  • Speaker identification
  • Email/WhatsApp sharing
  • Text export (TXT)
  • Resets on 1st of each month

4.2 Boost Pack (One-Time Purchase)

Cost: $4.99 / R82 (One-time)

Allowance: 1 hour (60 minutes)

Features:

  • 60 minutes of recording time
  • VoiceVault included
  • Minutes never expire (as long as app is installed)
  • All export formats (PDF, DOCX, SRT, TXT)
  • No subscription, no auto-renewal

4.3 Pro Pack (One-Time Purchase)

Cost: $14.99 / R248 (One-time)

Allowance: 5 hours (300 minutes)

Features:

  • 300 minutes of recording time
  • VoiceVault included
  • Minutes never expire (as long as app is installed)
  • All export formats (PDF, DOCX, SRT, TXT)
  • No subscription, no auto-renewal
  • Best value per minute

Minutes Policy:

  • Never expire: Purchased minutes roll over indefinitely as long as the app is installed on your device.
  • Uninstall forfeiture: If you uninstall the app, any remaining purchased minutes are forfeited.
  • No subscriptions: All purchases are one-time. There are no recurring charges or auto-renewals.
  • Anti-abuse: Attempting to abuse refunds will result in account termination.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use WeSaidso for:

  • Recording business meetings and conversations
  • Transcribing interviews and presentations
  • Personal note-taking and documentation
  • Educational and research purposes
  • Any lawful purpose consistent with these Terms

5.2 Prohibited Uses

You may NOT use WeSaidso to:

Illegal Activities:

  • Record conversations without required consent
  • Violate wiretapping or eavesdropping laws
  • Engage in harassment, threats, or intimidation
  • Distribute illegal content
  • Commit fraud or financial crimes

Privacy Violations:

  • Record conversations in jurisdictions requiring two-party consent without obtaining consent
  • Record private conversations without participant knowledge
  • Share recordings containing confidential information without authorization

5.3 Recording Consent Requirements

⚠️ Important: Laws regarding recording conversations vary by jurisdiction.

Your Responsibilities:

  • Understand and comply with local recording consent laws
  • Obtain required consent from all participants before recording
  • Inform participants they are being recorded when legally required

We are not responsible for your compliance with recording consent laws.

6. Intellectual Property Rights

6.1 Our Intellectual Property

WeSaidso owns all rights to the App software, design, branding, and technology. You may NOT copy, modify, or reverse engineer the App.

6.2 Your Content

You retain all ownership rights to:

  • Your audio recordings
  • Your transcripts
  • Your voice data
  • Content you create using the App

License You Grant Us:

By using WeSaidso, you grant us a limited, non-exclusive license to:

  • Process your audio for transcription via Google Gemini API
  • Store your transcripts in Firebase
  • Use anonymized, aggregated data to improve the Service

This license ends when you delete your content or account.

7. Data Privacy and Security

Your use of WeSaidso is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.1 Data Storage

Local Storage: Audio recordings stored on your device by default. Voice fingerprints stored temporarily (session-only).

Cloud Storage: Transcripts stored in Firebase Firestore. VoiceVault records stored immutably.

Third-Party Processing: Google Gemini API processes audio for transcription.

8. VoiceVault Specific Terms

8.1 VoiceVault Limitations

⚠️ VoiceVault is a Minimum Viable Product (MVP)

NOT Suitable For:

  • Legal authentication or verification
  • Court proceedings or legal evidence
  • High-security access control
  • Medical or safety-critical applications
  • Financial transaction authorization

Accuracy: MVP accuracy: 70-95% in ideal conditions. Accuracy varies based on audio quality and speaker characteristics.

8.2 VoiceVault Disclaimers

You acknowledge and agree that:

  • VoiceVault is not a certified biometric authentication system
  • Results should not be used as sole evidence of speaker identity
  • We are not liable for verification errors or failures

8.3 Immutable Vault Records

Characteristics:

  • Vault records cannot be edited after creation
  • SHA-256 hash ensures integrity
  • Soft-delete only (marked as deleted, not removed)
  • 3-step confirmation required for deletion

9. Disclaimers and Limitations of Liability

9.1 Service Provided "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9.2 Transcription Accuracy

We do not guarantee:

  • Transcription accuracy or completeness
  • Correct spelling of names or technical terms
  • Accurate speaker identification
  • Error-free voice verification

Your responsibility:

  • Review transcripts for accuracy
  • Correct errors manually
  • Do not rely solely on transcripts for critical decisions

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for indirect, incidental, or consequential damages, loss of profits, loss of data, service interruptions, or inaccurate transcriptions.

Maximum liability: Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or R100 (whichever is greater).

10. Service Availability and Modifications

We strive for 99% uptime but do not guarantee uninterrupted service. We reserve the right to add, modify, or remove features with notice.

11. Termination

11.1 Termination by You

You may terminate your account at any time through Settings → Delete Account. Unused purchased minutes are forfeited upon account deletion.

11.2 Termination by Us

We may terminate or suspend your account immediately if you violate these Terms, engage in illegal activity, or abuse the Service.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of South Africa. You agree to submit to the exclusive jurisdiction of courts in South Africa for any disputes.

12.1 Dispute Resolution Process

  1. Step 1: Contact us at support@wesaidso.app for informal resolution
  2. Step 2: If unresolved, agree to non-binding mediation
  3. Step 3: If mediation fails, litigation in South African courts
